M & T Bank

Worry Free Checking My Ass As of September 3rd, 2004, My "Worry Free" checking account balance is - $ 181.16. And I'm going to explain to you why. M & T Bank is from New York. They had purchased the bank I held an account in for years October 6th, 2000. Prior to that, I enjoyed knowing that when I made a cash deposit on a Friday morning, the money was available for withdrawal or to be applied to checks written the same day. Since M & T Bank came along, you could arrive at the bank at 9:00 AM, Deposit $ 1000.00 in CASH, and not see the money until Tuesday morning! Meanwhile, back at M & T Headquarters, the greedy bastards would slam you with NSF fees of $ 30.00 a shot. In all, I have payed over $ 1,500.00! Use your Check Card as a MAC purchase at the WAWA? Cha Ching! $ 1.50. Withdrawl cash from any non M & T bank ATM, including PNC Bank which does not charge you for access? Slam! $ 1.50 please. Don't use your Check Card? Cha Ching! That will be another $ 1.50. Web Banking bill pay fee? NEVER USED It but yes, every month, $2.95 out of my account. And what the hell is a $3.00 fee for return check option doing there when I do nothing but bounce them? (Will Post about this later) $5.95 -$160.71 07/01/2004 WEB BANKING BILL PAY FEE $2.95 Ok. Now some will say: "This guy just can't balance a budget", well your half right. In March of this year, I opened a checking account at Commerce Bank. No more slamming me with bounced check fees. Why? Well I can go there with cash even on a Sunday and deposit it, walk out the door, go to a MAC machine and the money is there to pay bills. So, getting back to M & T or I should say, M $ T, I went online and e mailed them concerning this. This is a few of their replies: (Note the dates.) Date: 11/10/2003 Message ID: 2259765 To: From: M&T Subject: Re: General Question (Sent 11/6/03) Dear Mr. Ward: Thank you for your email. Please note that cash deposits made before 2:00pm on a weekday will post to your account that same day. However, this will not appear in Web Banking until our system updates have been completed for that day. Updates do not complete until after 6:00am the next day. Because you made this deposit on the 5th before 2:00pm, it posted on that date. A review of your account record shows that you do not have overdraft protection. M&T offers a Line of Credit to be used with your checking account for overdraft purposes. If funds are not available in your account, the line of credit will transfer the dollar amount needed to pay the item up to the credit limit. There is a $1.00 line of credit transfer fee assessed for each occurrence in addition to finance charges on the outstanding balance. The finance charges assessed to your account work similarly to a credit card. This is a big savings compared to insufficient funds fees. There are three convenient ways to apply for a Line of Credit. As you are already a web user, you may find it easiest to visit our web site at http://www.mandtbank.com/ and choose the “Loans and Credit” option. From there you will need to click “Apply Now” and enter the appropriate information. When asked the “Loan Type,” choose “Overdraft Protection.” Of course, you may also apply at your nearest M&T Branch or by calling the M&T Telephone Banking Center at 1-800-724-2440. Thank you for banking with M&T. Well, that is not true. I have made deposits in cash well before 2 pm and have deposit slips to prove it! A line of credit? Yeah right, I was turned down. Why give me overdraft protection when you can get money from people like me? Now, they have a new type of checking account called "Totally Free". I inquired about it and was told by a teller that I'd have to pay off my account, then close it, then open up a new one to qualify. Now, does that make any sense? Banks should automatically give existing customers the new benefits. M & T Bank had $31.5 billion at December 31, 2001. And an office in the Cayman Islands. How nice.. Well, in the end, I will pay this off , cancel the Check Card and what am I with? A glorified piggy bank? Nah, I 'll just close the account completely. Banks should be investigated! I will say this about the bank. I'll miss the friendly tellers and staff at the local branch. That's one thing they have going for them, but remember, these tellers worked for the old bank, Keystone. Scumbag banks, they're all the same anymore, money grubbing friggin thieves, surcharge by friggin surcharge over millions in volume, it's how they earn their millions anymore, god forbid it actually involves actual BANKING! A neighbor of mine works as a senior VP for the largest ATM Machine company and they earn millions on transactions every day, he's mentioned the amounts they've earned over various summer holiday weekends and it would make your head spin. Remember these scumbags are skimming off of your money in your account, you haven't purchased anything at all except the "preiveledge" of using their ATM to get to your own money! Bastards. Go to a Credit Union, I use one and even have my bills paid automatically out of my checking account. I went with my stepson to get a small loan of $8,000 for a second used car with him. We Went to Commerce Bank, you know the friendly "Neighborhood Bank" that's opem on Sunday and all that shit! Guess what, they were staffed by monkeys who barely had the common sense to complete the loan forms before they forwarded them off to the regional office where people with above average intelligence must be kept at to process the loan. We walked out because they were so friggin inept, I called PNC and they did the deal over the phone in like 15 mins with an approval call back in a couple hours.   8. Hey, my wife and I just had the same experience with M&T bank. They're CROOKS! We overdrew $24 in 1 day. but there were 5 separate transactions. So we got hit with FIVE $32 NSF FEES. that amounted to more than 15% of my income for the pay period. $160 for effectively a one time $24 overdraft. I don't mind paying a fee, but that's usery, and just plain wrong.

  12. I'm sorry I don't live in Delaware county, but I do work for M&T. Just remember when you call that 800 # for help cause you can't get in touch with your local branch any more it's just a regular person trying to make a living on the other line. I have to say that I WILL do as much as I can for you without loosing my job. Those of us who answer that phone are the bottom of the barrel. We are not even aloud to get off those phones except for our 3 brakes a day. God forbid we have to go to the bathroom. We get penalized for it. And when you do get one of us who does spend some time with you to help sort out a problem just remember if we have gone over our 2 minute limit know that we can forget about a raise. I;m sorry again for not working for a better company but I need to put food on the table also. Beleive me if I did not get a free account here I would not be banking with M&T.

I want to know WHO CAN do something, but "unfortunately" no reps seem to know that either. When making purchases, ATM withdrawals and check payments Tuesday thru Thursday through my M&T Direct Deposit Checking Account, everything seems to post in the order they were transacted, but then the dreaded FRIDAY COMES. This is ALSO PAYDAY, so it is supposed to be a day of REWARD and excitement... after bills are paid there is usually some talk about how much extra money is left over and how my finace and I will spend some of the extra money over the weekend. We're simple people so let me show you how we spend it:

    I called the bank and was told that it was NOT a BANK ERROR. I said how can incorrect accounting NOT BE A BANK ERROR. Well I was told that it is clearly stated in those terms policies that WE AGREED TO that M&T posts all transactions in order from greatest to least. I TELL YOU WHAT- I NEVER AGREED TO BEING STOLEN FROM!! determined that M&T STEALS through their use of their "terms and policies".

    I called the bank and stated the error that if the bank had posted the transactions in the correct order, the account was only overdrawn ONCE. The rep agreed. I asked for ONE insufficient fee to be refunded and was told that it was NOT a BANK ERROR. I said how can incorrect accounting NOT BE A BANK ERROR. If the ATM WITHDRAWAL for $20.00 had NEVER happened there would be NO INSUFFICIENT FUNDS FEE... he agreed. I said well than how can the Bank charge TWO PENALTIES FOR ONE TRANSACTION. Well I was told that it is clearly stated in those terms policies that WE AGREED TO (I was with Allfirst BEFORE M&T and did NOT GET to SIGN ANY TERMS with them) that M&T posts all transactions in order from greatest to least. I stated that this only happens over the weekend and so surely he could see that the ONE EXTRA FEE was incoorect. He agreed but stated again that since it isn't a bank error there is nothing he can do. I TELL YOU WHAT- I NEVER AGREED TO BEING STOLEN FROM!! I've determined that M&T INAPPROPRIATELY USES their "terms and policies" to STEAL. The math is just flat out incorrect!!! AND to BOOT... concerning the insufficient funds fee I was "willing to eat", it looked like he had that $20.00 IN THE BANK from the available balance POSTED BY THE BANK THAT DAY WITH ROYAL FARMS SHOWING UP ON THE LIST OF TRANSACTIONS!!! I'm wondering what to do about getting this money they "stole" BACK?!?!?! THEN switching banks!

  19. Sorry you all feel the way you do. I have an account at M&T bank also and have never had a problem. I guess that is because I did learn early how to add and subtract and the lesson that you don't spend what you don't have. It's very simple. As with everything in life, if you learn the rules and live within them you have no problems. It is very easy to blame everyone else for our own mistakes. perhaps it's time to vue yourselfs and take a little responsibility. For the comment about the Credit Union , did you know that unlike banks they do not pay taxes. Where does that shortfall come from. Out of your pocket. Did you also know that banks belong to an ATM network and every time you use an ATM, be it at WAWA, another bank or even the ATM at your own bank, your bank is charged. YOU don't get something for nothing in life. Sounds like most, if not all, of these replies did not pay attention to their finances and it sounds like never will- your loss

  21. I thought I was the only one, mostly 'cause they are still in business. They were great before they changed ownership. Suddenly my accounts started acting quite differently, in that annoying inconsistent way. I have had a zillion banks (because I move and travel a lot) and I have never before or since closed an account with prejudice. The only good thing I can say is that at every branch I used, the staff was really very friendly. But it was the staff from before the buyout/merger or whatever.

    But the bank's inconsistent application of when to post a deposit gives them the dubious honor of being the only bank to ever insufficient funds charge me. And although it only happened one time, I had noticed for a few months beforehand that cash desposits seemed to be posted from within 2 minutes up to 5 days later. If you make a CASH deposit ANYTIME after 12 on Friday, half the time it might not be posted until Tuesday, and if you make a cash/check desposit, they may or may not credit you with the cash before the check clears. Doesn't matter what their official rules are, this is what happens. I complained a bit but in the end, even if I had gotten them to fix it (and based on how much I kept in other accounts at their bank, I'm sure I could have gotten it fixed) I knew I couldn't trust them; having a dependable bank is crucial to me. They have lost far more in my business than that fee, not to mention my friends and family were advised to stay away.

    So I moved my accounts to Fleet (er, Bank of America) and eventually opened another with Commerce. I still have my largest Eagle account as well, so it's not that I have anything against smaller banks, or being with a bank long-term. Really, M&T is the only bank I've ever had a problem with. Nothing to do with math, addition or subtraction, nor intelligence, except anyone who continues to deal with an inconsistent/unfair bank might not be the brightest.

  23. Having been both a consumer and an employee of M & T Bank (19 years and no longer there) I understand the frustrations that customers feel towards the New York based bank. We lost our "home town" feel when we became M & T and have never been forgiven one day for it. Unfortunately, all banks are alike, Wachovia, PNC, Commerce, every one. The employees, and I take offense the jackass who called us monkeys, take a daily beating from corporate headquarters who have no idea what goes on in the trenches of branchland and the customers who have absolutely no goddamned idea what the hell they are doing in their checkbook! I understand that you have to cut finances close to the bone, but let's be real for one minute: most people who are bouncing and having problems with their accounts are consistantly the problem accounts. 19 years of customer service is now speaking....you all know who you are...shut up!!!! get over it....you have screwed up and are now having to face the piper. tough....stop blaming every one else but yourself. Move on and stop making everyone who works at the bank cringe every goddamned time you walk in. If you aren't happy, here's a clue: find another frigging bank to piss off and go.....

  24. So what your saying that "It's Ok" for M & T to charge you for not using a check card? For using a check card? It's OUR money, not theirs! Didn't you even bother to read my post? The only thing that I miss about M & T is the tellers that I dealt with over 10 + years.


    Bottom line? Screw M & T bank. I hope they fold up and go away. Their corporate greed and illegal crap like suddenly charging for NON USAGE of a check card makes me madder than hell.

    I no longer have them as a bank and I tell EVERYONE I know and meet that they SUCK.

    What would you do ? This wonderful country of ours leaves the working poor with two choices.

    #1 go to one of those thieving check cashing places and ultimately get ripped off and end up owing MORE money...OR

    #2 Write a check for FOOD from one of these thieving banks and get charged "NSF" (pretty words for the evil act of usery, wouldn't you say?) and end up owing even more money to these soulless creatures.

    Well, what would you do ? would you STARVE ??? Go to work 8 hours with nothing to eat ???

  27. After today's indecent with M&T for not using the card every 3 months. I owned them 2.87 from there freakin fees. (BTW the account is closed) Not only i am not happy, there web banking is so screwed up. It would take a day or two just to get there money in. I shouldnt be penlilized for not buying anything for 3 months. Cant wait to go to a different bank.

  29. I hate M&T Bank too. I found out the hard way this week about M&T and their ways. Turns out that when you make a purchase of say $10.00 - M&T will place that amount on "hold". If the merchant submits their paperwork on time - you will see that $10.00 posted to your account with the merchant name next to it. If said merchant waits until next week to submit his paperwork - then after 2 days the $10.00 will be put back into the M&T account. Because they did this to me - I was overdrawn by a WHOLE WOPPING $0.56. Thus, causing a $35.00 fee. So I find this out from calling Customer Service to see if they could reverse the fee before other charges would go through. Of course the drones state - "If its not bank error, we can't do anything about it". Then I get lectured by CS about how I should keep my bank account balanced. So, I call the branch - NO MANAGER. Next day, I see my account hit with 4 more $35.00 charges. I called the branch again. Spoke to the manager and she reversed $70.

    I see two places where the bank made errors. One - There is no disclaimer on the website when you are trying to balance your account. TWO - had the manager been there yesterday and reversed only one $35 charge then I would still have money in my account.

    And right around the holidays too! What a bunch of Scrooges!

  30. We have a car loan through M&T bank. It turns out they cashed a check in Nov for October's car payment and then resubmitted a COPY again in Dec. Plus, they submitted December's payment the same day. This bounced my account. My bank, Commerce refunded my overdraft fees:)and said it was M&T's fault. When we called M&T, they said that our account is up to date and they have no record of being paid twice on the same check. Of couse they said it was Commerce's fault. M&T submitted both checks AGAIN. Has anyone else had a simular experience?

  31. I found this post completely by accident. Wow. I thought I was the only one.

    Before this year, I had never bounced a check in my life. NEVER.

    In February 2005, because of M&T's complete mess of an accounting system and totally inconsistent manner of posting debits and credits, I was overdrawn by a few bucks (can't recall the exact amount, but it was less than $5.00). For this, I was charged FIVE $32 overdraft fees.

    Then in April 2005, I was again overdrawn by a similar amount. This time I was charged SEVEN $32 overdraft fees. The branch reversed two of the fees, and told me that the bank headquarters would reverse two more. Of course, that never happened.

    The take-home lesson? I now check my account balance online EVERY SINGLE DAY without fail. I find it astounding that I have to do this, considering I've lived through many years of checking accounts at various banks and have never had to do more than keep my checkbook updated and reconciled to the monthly statement. But I will NEVER go through another experience like I have with M&T this year, and if monitoring them daily is what I have to do to ensure that, then so be it.

    At the time that the overdraft fees were assessed, I was also told that I could apply for overdraft protection, but was ineligible for the bank's line of credit. This left an M&T savings account (at a pathetically tiny interest rate, mind you) as my only option for overdraft protection. So I opened one.

    But of course there was a catch: the bank charges a $5.00 fee every month that the savings account has a balance of less than $250. Great.

    Now, despite my careful budgeting, educational level and attempts to find a better-paying job, my financial obligations cut it dangerously close to the bone every single month without fail. Thus, after months of saving, I finally just build up a balance of over $250.

    So I was very surprised when I noticed that the bank charged me the $5.00 fee for this past month. I called them and asked the customer service rep, "I don't understand. How could this happen? I had an average daily balance of over $250, didn't I?"

    And her answer? Yes, my average daily balance was actually well over $250 this past month. But the previous month's average daily balance was below $250. So they deducted last month's $5.00 charge from my account at the beginning of this past month. This brought my account balance to $245 for TWO DAYS, and evidently you must maintain a balance of at least $250 EVERY DAY OF THE MONTH for the fee to not be assessed.

    This was the first time in my life that I have ever heard of such a thing. It made my head spin.

    Lucky for me, the customer service rep reversed the most recent $5.00 charge. Whoo-hoooooo, what a cause for celebration!!! I'm amazed that I actually get off scot-free for one month. And I should enjoy it, because I know the $5.00 fees will return when I have to tap into that money for necessities soon.

    So be forewarned, folks.

    Nothing but cutthroat scumbags who only care about the bottom line. I wish a class action lawsuit would happen, I'd be right in on it.

    I also now have Commerce. As I stated, I do have a rough time balancing my accounts but at Commerce Bank when I deposit money it becomes avalable before I walk out the door.

    Coupled with the fact that they are open on Sundays they far out preform M & T. Commerce Bank and PNC are two banks that you can trust.

My story is too long to even partially get into, but suffice it to say that they've stolen $600 from me ($100 in fees, and $500 in deposits that they say they never received, even though I have receipts to prove it) and are now making me drive 1.5 hours to my "home" bank in order to straighten it out. Hopefully I'll get my money back, and then I'm switching over to a well respected local bank. M&T are SUCH bastards.

  35. This is just about how I feel with M&T Bank after waking up with a (-)3.25 balance in my account due to bank fees. Not to mention just YESTURDAY I had a negative balance because of a DIFFERENT fee for web banking and bill pay. I DON"T EVEN USE THAT SERVICE! So that fee got reversed after I called customer service and told them they needed to reverse it. This morning however, I have a 1.75 ESF Fee for using a Bank Of America ATM. THEY CHARGED ME 2.00 AT THE ATM ALREADY! So because I wanted to withdraw 10.00 , with fees, that 10 now becomes 13.75? that doesn't seem logical. AND on top of these two incidents..the person who signed me up for M&T Totally Free Checking (which is a statement all in itself it doesnt seem totally free to me) but the person signed me up for something else so 3 months down the line I get a 14.95 Service Charge because the first 2 months were waived I didnt even realize they were charging me, which put me in the negative with another purchase because I wasn't aware of the charge, THEN they charge me $35.00 NSF Fee for EACH transaction including their own service charge!. So I was $84.95 deeper in the hole, which when I went to my branch the woman reversed the fees for me but she didn't seem so convinced IT WASNT MY FAULT! I keep a register, I am not psychic, and I don't know when these mysterious fees will appear!... So since the account was changed back to what it should have originally been, totally free, I have been receiving $0.50 charges each time I use my check card. When I signed up for my account they told me to use the Credit option because the Debit option charges 0.50, so tell my WHY once I changed my account to totally free checking, and in my history of being an M&T customer I have NEVER gotten a 0.50 charge before, why when I change my account would I change my habit and decide to use the debit option when I ALWAYS use the credit option!, So there is an additional $2.50 in charges for Check Card purchases. I am going to the branch today to get those reversed because I guarantee you, I am -3.25 in my account right now, 1.75 due to their fee, and another 1.50 due to 3 separate 0.50 charges, I guarantee you I get hit with not 1 not 2 but 4 separate $35 NSF fees if I don't go correct the problem today. I wish they would do that shit, I bet they do! I am so sick of M&T!!! Keep in mind I have only been an M&T customer since LATE February of this year, and all of these fees have been happening. Absurd!

I now have the same $99.95 transaction listed 8, yes that's right, 8 times. I went to make a purchase and discovered I didn't have the money to cover it. I thought this was stange as I had dropped about 400 into the account about two or three days before. So, I looked up why, and there you go. Same transaction listed 8 times. Just under $800 gone, when there should have been only $100 gone. Fuck banks.

You're telling me in the year 2006 a financial institution like M&T Bank isn't advanced enough to keep their online banking in real-time?   39. I just wanted to add a comment. I used to work for M&T and let me tell you it is a horrible place to work. I hated working there. The higher ups (i.e. regional and area sales managers) are a bunch of a**holes. The branch managers are not too much better either. I was hired right out of college, as M&T says they try to attract the brightest and the best... well, if you are right out of college and looking for a job, do not apply there. M&T is all about sales goals. That is truly all they care about, making sales goals, and making money off thier customers (i.e. fee income). If you do not make your sales goals (which are very hard to meet) forget about going anywhere with this company. They do not care about their customers or employees. If you are a regualar "joe" customer with just a regular checking and savings, they don't give a shit about you. You are not considered the "ideal" customer. M&T tells us this during sales meetings. They are looking for customers who can bring them $$$. So don't even bother banking there unless you have something to invest...otherwise, they will fee the sh*t out of you and treat you like dirt. M&T...you suck!!!

    They can blame the consumer all they want but this change in strategy for M&T of manipulating transactions from one day to the next is unethical. There is no reason why transactions should show-up in your account on one day and the next day these transactions a gone trying to make you believe you have more money than you do. This never used to be a problem when the bank was owned by Chase.
    This is obviously an intentional tactic to bleed consumers of their hard earned cash.

    I hope the executives at M&T burn in Hell for this!
    Again anyone who defends this activity is feeble minded.
    I am going to the Better Business Bureau, I may not matter much but I would think if everyone did this sooner or later they would be investigated.

  42. I just lost $555 to the bank all in NSF charges because of their incompitence, now I’m wondering how to pay the rent! The M&T Bank is made up of legal theives. They wrap themselves around asinine contracts, that are explained differently by every person I've ever talked to at 3 different M&T branches. Their records change daily, and at their discretion.

    Let me tell you my experience with them. My wife and I just received our tax rebate check the other week. We made it in before 2pm on a Fri. and were told EXACTLY that the money would be credited for Saturday. We have a baby on the way and a son....so needless to say we picked up groceries, paid bills, and with the weekend off, bought our long-awaited nursery stuff. (Maybe spending $1000 in checks and $500 in ATM use out of our $1600 check with a check for $1500 deposited on Sat. morning)

    Now, come Monday everything is fine. Tuesday everything is fine, other than no available balance. Now FINALLY Wednesday rolls around we have 5 NSF fees. I called the bank, they gave me a bunch of crap and wouldn't work with me at all. They told me out of the 2 checks I cashed 1 was deposited and available, and the other would be at midnight. I let it go although it was $37 a pop because I was reassured that no other fees were to be taken out.

    Thursday: a bill I paid Sunday came up for some reason as a NSF fee, another $37. I was angry because I was told no more fees, but decided to let it go, as nothing else was bouncing.

    Friday: I log in and nearly killed myself. 5 more fees. All for checks written for my son's nursery. I'm up to 12 NSF fees now because a teller told me it would be in the next day, and the check didn't clear until Wednesday for some reason. I spent an entire day on the phone arguing, with no avail. Went to the office, 30 miles away, and got the lady to agree to request our money back from the company. Apparently the bank manager doesn't have the power to give you a refund!?!?! She finally leaves a message on my machine at 7pm that night that the bank only agreed to give us half. Thats $222 out of $444!

    Now today is Wednesday, dealing with this for 2 weeks!, and low and behold, I haven't received my refunded money yet. To top it off, a check that was written on the 4th from the same place that bounced 5 others shown up, and mysteriously was added before 2 other transactions that were in my account 2 days ago. This will be another 3 NSF fees, and NO REFUND YET.

    So as of today I have 15 NSF fees for $37 a pop. ALL bank Misleading errors, all money I put in straight from H&R block, and all the records are out of order (tampered?). We are now seeking legal advice, and plan to take action immediatley. Our bank, has been doing this to us for 2 years, and due to convenience, and much smaller charges, we just let it go.

  45. I hate to bring back something from the dead but this is the most in-depth blog that I have found on M&T. To start with, I fully understand NSF charges and feel that the bank has a right to collect as such charges. Their right to collect these charges is clearly defined within their terms of service. I have had an accounty with M&T for many years and with ALLFIRST before the take-over. I have always been satisfied with the service. I have never been charged a fee that I did not diserve and have never complained.

    With that said, over the last 30 days (starting about the same time I added a joint name to two of my checking accounts and my name was added to my wife's checking account) I began to notice NSF fees where the account never went into a negative balance. In fact the only time that the available or total balance ever became negative was as a direct result of NSF fees. I could go online or check via telephone, have a total balance of $700 and an available balance of $300, make a $20 VISA POS purchase, and be charges a NSF fee.

    I went to see my local branch manager (not my "home" branch where I opened my account where I used to live many years ago) and she could not explain the charges. After she made a lengthy telephone call to corporate she informed me that the fees were due to holds that were applied to the account from POS purchases and that even though the merchants had submitted for payment and been paid, the fact that the holds were in place at the time to merchant was paid caused an overdraft. She stated that this will not show up in the total or available balance and will only be seen in the daily collected balance that is computed retrospectively days later. She further explained that the only way to prevent this was to maintain twice as much money in my account as I would ever use in the course of a month. She further stated that M&T should refund most if not all fees (just shy of $1,000 in 30 days) however this would need to be done by my "home" branch manager. The home branch manager would not return telephone calls from either myself of this branch manager and as such no fees were refunded.

    The funny thing is no one at M&T has been able to tell me how, with no changes to my spending / account maintenance habits, this started to all happen in the last 30 days when it has never happened in the last 10 years that I have had these accounts. I have now closed the accounts and have fallen back to my credit union and ING Direct for all my finances. After reviewing the account history, terms, and disclosures with my accountant and the manager of my credit union I have been advised to take them to small claims court.

    Again, I have no problem paying a fee where earned, just not when there IS NO NEGATIVE BALANCE.

Like you said it takes days for them to put your money in and yet they allow you to still use the money because then they can charge you NSF fees. My husband only gets paid once a month and they wouldn't give me credit for a week. I was charged well over 400.00 in fees. Stopped my web banking and they are still charging me for that. I sent a letter to board of directors and president at M&Tand they only reversed 1/2 the fees. Closing out my account. Recently opened up an account with a credit union and they immediately give me credit for a payroll check.

    Too bad we all couldn't get together and sue them.

    I have looked into this matter, and after opening up yet another M&T Bank account that yet again had a few hundred in NSF fees, etc, My attorney has contacted others and also has monitored this specific blog post to weigh the gains and losses on a class action law suit against M&T.

    I am waiting for my credit report to come back. If they put me in as a bad debt over thier bullcrap fees, I'm going forward with it.

  48. I found this web site by accident because i too am a very frustrated past customer of m&t bank. They have charged by so many NSF fees because of the way they do there bookkeeping/web banking. I recently sent a letter to the board of directors, president about all my fees and the way they deposit my money. The corporate office did respond to me, only to reverse half of the fees. I don't deal with them anymore, I opened an account at a local credit union and my money is credited as soon as I deposit.

    If anyone wants the names of these corporate people in new york and their address/fax number. I would be more that happy to post it here.

    Also, if need more people for a law suit. I'm in.

  50. M & T bank is crooked. They have cost me thousands of dollars in overdrafts. I was an employee there at one point, so I don't care about any current employees point of view. There is stress with dealing with customers for a reason. It's amazing how wasteful that company is too. In the IT department, they waste more money on meetings and spend months and hundreds of thousands of dollars for something that can be done at 1% of the cost. Wonder why they screw their customers over. They have to pay the bills at some point, but yet manage to make billions.

    Their transaction algorithm is crooked. They don't use the natural order of how bills come in. They will pay off the largest bill first and overdraft all the little ones. So don't be fooled otherwise. Their argument is that the larger bill must be more important. That is BS because regardless of any order, the transactions go through anyways. You pay for something no matter how that unfolds.

    Even carefully watching the web-based banking I still over drafted 3 times, because a merchant charge from 2 weeks ago just suddenly appeared. Can you f'ing believe that. We we're extra careful.

    In my opinion web banking should maintain a balance that is accurate (as if you balanced your own book.) Otherwise, why have web banking. Web banking is just an illusion then, a money pit for unsuspected customers. As soon as a check is deposited the amount is recorded anyways, so whether the check has cleared or not, you should not be able withdraw money from ATM's if it exceeds a pending balance or overdrafts shouldn't be configured until all the pending money for that day is resolved. When I deposit a paycheck it should be treated as if I deposited cash that day. If my check doesn't clear then by-all means charge me a fee. I could even live w/ paying $37 overdraft if they consolidated the charges for the day. Instead they will bombard you for every transaction.

    Watch out for hidden charges from stores now too. Walmart charges $0.50 if you use your card as debit. That could cost you an extra $37 in fees if you are not careful. This can be multiplied if you had to stop at Walmart 2 or 3 times that day.

    What's this shit that banks can charge $37+ dollars per overdraft anyways. What happened to the days when it was just a few dollars. A total overdraft for the day could total $3, be 3 separate transactions, and cost you $111 dollars in penalties (Glad they didn't come to my house and break my legs.) A pretty unfair gain for the bank for using 3 of their dollars. Try having that kind of earnings in the stock market.

    All-in-all, we may not be the most responsible, but in no-way have I ever been penalized like this from any other bank. Usually you mis-calculate once in a while, get an overdraft, and usually can talk your way out of it or have it consolidated.

    For all of you who could qualify for a line of credit, I suggest signing up for a checking account at ingdirect.com (electric orange.) They give those who qualify $162 line of credit instead-of overdraft fees. So you pay 12% interest on what you borrowed. In the case of the $3 scenario, you would pay the 3 dollars back plus $0.36 (big difference.) Also, ingdirect pays 4.5% interest annually (deposited daily), for having your money reside in a CHECKING account. Their savings account is usually 1% better-than that as well. No hidden fees and you can withdraw money for free anywhere an ATM says Allpoint on it, which is practically everywhere. Which is way better than M & T. I live in the country and there are at least 3 within 7 miles.

    Middle / lower class people (the victims) will eventually get wise and migrate elsewhere and banks will suffer the repercussions. I wouldn't be surprised if a class action suit happens and banks like M & T will have to pay millions to it's customers in retribution. Until then lets keep fighting.

  51. I tried to close out my M & T bank account today and they would not let me because there are two pending overdrafts. The overdrafts we're caused on a day that happened to have two minor transactions. Here is the rub, the transaction originally occured on the 2nd of July, but mysteriously shows up on my statement the 13th, a time that they could overdraft us multiple times.

    There is no way this is possible, without M & T pulling some scam. Anyways, I hear the word is to complain to the SEC. I am also waiting to jump on board of any class action suit.

  52. Hello, I to am going through the usf fees, I got 5 today and will get another 5 tomorrow. My account was in the positive yesterday and they said something was pending on my account and that is why I got socked with the first 5 fees. The odd thing is the payments they charged me the usf fees for were already cleared and paid for last week. I made a deposit yesterday to cover any new transactions and now my account is under again from the fees. Lucky I made screen shots of my account online yesterday and today. You can clearly see that my account was in a positive when the 5 payments were made. How can they jusify that. HELP!!!

  53. I have been following my Web account for the last 6 months and have found several mistakes. Once they tried to nail me with 2 MSFs when I still had money in the account. Twice the MAC ate my card due to mal-functions and twice my deposit was stuck in the machine for 2 days. Just yesterday I found the wrong photo attached to a check and it looked like they took 100.00 dollars more out... When I went to the branch to complain, the manager started to yell and I yelled back at which time I said I was going to get legal with him.... after a few more spars, he said he is going to close my account, I said you can not, I have 3 checks out.... He did anyway. I am filing a law suit. I will not win, but I'll have my say in court... These M&T people seem to be real a**holes.

  55. So like others I received 4 NSF fees when in my bank account I never bad a negative balance. I call Customer Service and was told blankly this is not the banks fault. I asked to speak to someone else who would help...she said...there is no one here to talk to you....what???? are you telling me there is no one in power that can help me?? anyways that seemed to be a lost cause. I went to my local PA bank and was told you need to have better checking skills the online banking feature does not accuratly display your real bank account. I get so frustrated I just begin to cry. I understand what you are saying but you still charged me. I am explained that though the money for a bill was not taken out, it was "held". Anyways I leave with nothing! Finally I call the bank that I began with back in my old home state and talked with the manager 2 minutes, he was the NICEST man and said he understood and reversed 3/4 refunding me 111! I couldn't believe it finally someone understood me!!!!!! so I have to say is that M&T does suck sometimes but there are some super nice people against the muck.

  56. Well, I also took the steps to contact the president and the board of director of M&T and was able to get 4 NSF fee out of 8 refunded. I had no luck with the local offices about the dispute I had. They wouldn't even return my phone calls anymore. They repeatly lied to me when I did talk to them. However, I read a post here to go straight to the top and that is what I did. I was tired of being treated like a low life and emailed the corporate executives and got a phone call about a week later. No questions asked she said she is willing to dropped 4 of the fees. If you don't get anywhere with your local office or the customer service number then go to the top. Good Luck!!!

  58. Hello, the person that contacted me back name was Nancy # 716-635-4187 x8304. The BOD had her call me after I sent him an email with my dispute. I did this by looking up the corporate contacts and doing a little detective work; I figured out the way they had set up their emails or least was hoping I did. I didn't think anyone got it at first but low and behold a week later I got the call from Nancy. i.e. First letter of the name followed by the last name and @mandtbank.com. Hope this helps.   59. Well I from 7/16 have filed a complaint with BBB. M & T does not give a crap. They stated to me that they investigated my account and all my overdrafts are my fault. They aslo stated that after 3 days they remove a transaction from the web statement if they do not get the paper work from the vendor. Can you believe that shit. The online banking should be almost a replacement for balancing your check book.

    I still find it unlikely that a vendor, where I used my bank card on 7/2/07 failed to submit paper work until 7/13/07 and on a day that I happen to have two transactions that could cause up to a total of 3 over drafts.

    Apparently there are some account terms that we're brought to my attention when I signed up but that is pure BS.

    I read somehwere that the user agreement does not hold up in court when the fees are dubbed un-reasonable. Do you know that you only cost the bank a few dollars per overdraft, but yet we must pay nearly $40.

    Also, if you want to file a true complaint, go to the federal reserve website and file one there.

  65. I received a voice mail on my cell phone yesterday from the IT security division of M&T bank. The person said "Let's cut to the chase". Please remove the post dated 3/31/2007 concerning an employee of theirs.

    After reading the post, I did remove it. I have had bogus DMCA complaints lodged against me before from a certain person called Michael Crook (Google him sometime) and cannot afford to have the EFF involved with defending me and this web site.

    Ain't I a nice person? How about M&T refund me all the money I spent on their overdraft and non usage of check card charges?

  66. Good ole M and T back at it. I deposited a 200 dollar company check from my employer on Friday afternoon and went Christmas shopping on Saturday. Needless to say I only had 100 dollars available to spend and they nailed me with 5 37 dollar nsf fees. What a Christmas gift huh. I argued with M and T for one hour and got nowhere. I am closing the account beginning the new year.

M&t did the same thing to me...i was overdrawn because they had me signed up to some kind of online banking thatt charges fees..and once the banking realized their error they removed it and told me they wond charge me anymore..now it was their fault i was overdrawn by 1$ but then they started to attack me with so many fees and no matter how much i pleaded nothing would get resolved I mean nothing..these guys are cruel im a student struggling with no money whatsoever..

  72. Commerce Bank is awful. I deposited a cashier's check and it wasn't until I called a week later did they tell me I couldn't access the funds. And yes, it was a cashier's check. After a dozen calls, visits to the branch, countless emails, I have heard it all and no solution in sight.

  73. I moved from Detroit to Baltimore, and like most people who move had to switch banks. This is by far the worst bank I have ever dealt with. From the first day I opened up my account I have had nothing but problems. They held my first 6 paychecks (all deposited at once), I mean really how was I suppose to live. At least once every quarter they pull some bullshit move to screw me out of NSF fees. In May the website was being worked on due to transfer issues (a rep at my branch told me this), well I happened to transfer money from saving to checking. Low and behold the website transferred the money from checking to savings therefore creating NSF fees. I made a deposit on Thursday in the amount $545, this is in addition to my normal payroll that it on auto deposit. They held the GD check, but showed the amount in my balance. Today I had three NSF fees. I hate this bank I wish I never opened an account/

  75. M&T bank sucks! They cheat you. They charge you fees for everything. They charged me fees for a few dollars overdraft of ATM when I did not ask for overdraft protection and made it seem like there were funds availble. They are the only bank that then says, check your balance before trying to withdraw.
    Then the thieving crooks froze my account because I criticized the bitches who work there. They hung up the phone on me and said "hee hee you don't even know my name to complain about me".
    This f worst bank is closed for customer service during non 9-5 and on the weekends.
    They ignore your emails and complaints.

    Feds, shut down M&T crook bank!.

  77. I'm going to give you the super magical secret to avoiding NSF fees:

    Learn to balance a checkbook!

    As for holding funds for 3 days against purchases made with your card, then putting the money back...let's say that you swipe your card at a place and it "doesn't go through" (we've all heard this)...sometimes it really does go through, and the bank has to charge you for it. How does the bank know that it's not a real purchase? They don't. So they compromise: They hold the funds outstanding for 3 days. If no receipt is presented, the funds go back in the account. If you aren't keeping your own checkbook register , then you have no clue how much money you really have. This is 100% your own fault.

    As for branches telling people incorrect information...what do you expect? They get paid minimum wage and are the lowest denominator at M&T.

    You Suck. Go work at M&T if you don't, and stop tryin to act like you are perfect with financing. If we all could be eaxctly perfect in our check book and new exactly when the bank was going to charge us for stupid shit, then, yeah, maybe the bank would have a leg to stand on.
    I actually had someone, who worked at M&T tell me that if I closed my account before 2 years, or it was inactive, that they could charge me for it.
    This last time, I called about the -$299 in my account and found that I made a total sum of $30 that I didnt have in my bank, so is it right that they charge me $261 for it. NO! So, anonymous, since you have a good idea about M & T and would like to support them, why don't you support my NSF's.

  79. M&T is the absolute worse bank I have ever done business with. Recently, I deposited my STATE GOVERNMENT unemployment check - and they put a 3 day hold on it without telling me. When I paid a bill 4 days later, they charged me NSF fee's of $32. Apparently I am supposed to ask for my "available" balance" when I make a deposit then check my balance daily. ???

    I am still waiting for the Branch Manager in Arlington to call me back about this. Left a message Thursday and haven't heard from her yet!

  80. M&T are cheats! I check online constantly to see if checks clear etc. I had extra money in my checking so I transferred it to savings since my paycheck was going to be deposited the next day. (this was around 4pm). I mailed out checks to be covered under my new paycheck and I kid you not they backdated the receipt date of those checks on the day before my paycheck came in. I know when I mailed those checks and it would be impossible for them to have received them the days they put them through! I noticed this on several (about 3) previous statements that they backdate checks on the date before my paycheck comes in. I mail my bills Thurs and get direct deposit Fri. my online statement looks fine up to Mon then Tues I see all these bounced checks dated for the previous Thurs! This is insane! I get the "our system doesn't update right away line" etc. I'm done with them!

  82. I have been incorrectly charged as many as 6 overdraft fees for what was supposedly a hold om my account. It currently has a balance for that day in the positive on my paperwork as well as the papers the branch manager gave me. The hold in question actually didnt apply to my account until today not 4 days ago which is going to cause another overdraft. I have also noticed the fees are debited before my transactions that make it appear as if i didnt have the money to cover the transactions which i would have if the fees were not erroneously assessed. I also notice that debits are rearranged highest to lowest to force the highest amounts through and therefore cause more fees to be incurred. I believe this to be in bad faith and an unlawful, deceptive business practice. I have been a loyal customer of this bank for close to a decade and I am very unhappy with the treatment I am receiving
